History of HXNY Election - 1
HXNY竞选历史
一个人从读历史评论中得出的结论总是有倾向性的。为什么呢？提供史料的人就
会有倾向性。写作历史的人也有倾向性。你读之前可能已有倾向性， 等你读完后
再得出你自己的结论，又会把自己的倾向性加进去。我写的是我自己的观点， 你
可以从我有倾向性的写作中得出你有倾向性的的结论。
2006年以前，HXNY没有校长竞选。 那时校长是由董事会提名一人，家长们象征
性地投一下票。 当时似乎没什么人想干此活。 反正没听说有人向董事会要知情
权和选举权的事。想想看，此职位当时是没有任何报酬，你傍晚下班回家就会有
与学校事务有关的电话接踵而至，直到半夜。听说有前任校长任期届满而找不到
新人接手的局面。
那时大概多数人还在美国打拼不久，立足未稳。 事业与家庭的压力使得人们还没
有过多精力能够投在其他政治事务中。中文学校规模也不大，每年入学人数有
限，还有人在排队等着入学。家长老师们彼此相识，和睦共处。
2006年，不知为何，有几人突然同时想当校长， 董事会也觉得可以尝试一下竞
选。于是，从三个报名之人（A, A1, E）中选了两人(A,A1)出来竞选。竞选当
天，两人发表竞选演说，在场家长当场投票。其中一人（A）以一票（一说4票）
之差险胜。选票总数不过数十张而已。选后， A任校长，A1任家长会长。两人任
上合作甚洽，成为好朋友。
这场HXNY历史上第一次，像一场体育比赛中友谊赛似的竞选貌似圆满结束，却
给日后HXNY的竞选埋下不少伏笔。
首先，那次被董事会否决的E君，乃现任HXNY之校长也。此君服务HXNY时间甚
长，一直掌管HXNY的IT系统至今。但每每提及此次董事会的挑选，便摇头不亦,
觉得是被“交易”出局。至今一提起董事会仍不以为然。董事会中“交易”一词沿用
至今。具体细节不得而知。但当时董事会中的董事们今日早已不在董事会中任
职。 其今日之举是否有些触景生情的因素呢？笔者不得而知。
其次，这次竞选也让人们误认未来的竞选也将是类似的友谊赛。乃至至今仍无人
致力于完善选举法细则。当后来友谊赛演变成动真格儿的淘汰赛时，竞选就变成
了一场没有裁判，规则不全的闹剧。
比如说，竞选双方只被安排在投票当天作竞选演说。 这就给各种舆论制造者很多
时间制造各种舆论， 双方又无法澄清，家长们也无法弄清真相。功夫在诗外！等
到了投票当天，人们已拿定主意,竞选演说也就根本起不了什么作用了。试想，如
果能多安排几场公开的辩论会，许多问题不就可以澄清了吗？
还有，学校资源能不能，或怎么样用于学校的竞选？如果竞选人不能通过正常渠
道向家长们传达他们的信息，又没有辩论会，家长们怎么真正了解他们及其主张
呢？如果管IT的人能控制什么样的信息在什么时候能与什么样的人见面，那他的
权力是否太大了呢？
另外，修改Bylaw由此开始变为计划赶不上变化的活动。年年因为选举修改
Bylaw， 有时边选边商量能不能不按Bylaw作，有时事后再改， 有些“摸着石头
过河”的感觉。

Since Gary Guo became Principal, HXNY has never been peace anymore. Two dance teachers and a origami teacher left school that year. Gary Guo spend more than $10000 for Kun Jiang's performance in SUNY Purchase. What's to do our school?
2007-2008, Gary Guo wanted to be Principal for the second term. But he got rejected. So, he forced Gutuan Zheng to accept Peiwen Yang as running mates. Otherwise, Gutuan couldn't be Principal.
2008-2009, Li Lin and Ying huang went into election. If Li Lin got elected, Gary Guo, Li Lin, Huang Gao and Peiwen Yang would sit in the Board the year after. Lots of parents felt uneasy with that. Therefore, Ying Huang won the election big time.
2009-2010, This year was relatively quite. Parents felt that Shengjing Li was capable and there was no other person would like to come out to compete. Ching Zhou wanted to get into school Board for some time. He wanted to be Principal at the beginning. At the end, he agreed to be Shengjing Li's running mates persuaded by other people.

ReplyDelete以上一段话是从网上摘下来的。我以前说，董事会不择手段，不顾后果，不惜代价，排除异己，今天看了这段话，更让我相信，你们是想置人于死地。请问董事会，你们能把别人往死里整，难道家长就不能用同样的方法对付你们吗？很多家长都想放弃，离开这个学校，让你们自己折腾。但现在他们发现，他们不能走，他们走了，就没人再反抗，你们就更无法无天了。我告诉你，这些家长们已经决定不走了，就待在这个地方，你走哪儿他们跟哪儿，家长们会一直跟你们斗下去。从现在起，你们每一个人都会在网上一一披露，你在董事会呆多久，家长们就披露多久。记住，你们在华夏的日子不会太长，在这一段时间里，你们的日子不会好过。家长们的克制是有限度的。昨天家长们发起了的只是第一轮：你们利用华夏做跳板，做舞台，进入OCA, 再用OCA来达到你们个人的目的。家长们还会往深里挖。

Both my wife and I are very sad to see what happened to Principal Wang. Li Shenjing claimed to everyone in the meeting that "Alan and I are best friends for many years. My kids get all the used clothes from Alan." This is Alan got for being Li Shenjing’s best friend: impeachment, illegal removal from elected post, law suit, restraining orders, big lawyer bills, sleepless nights, and crumbling health... This kind of friend makes me shaking.
ReplyDeleteOver the past month, I am disheartened and shocked to see all the indecent and illegal behaviors from Li Shenjing and his 5 gang board. The latest one is the fake law suit and restraining orders on Alan, Cai Xiaodi, and 10 other long time volunteers. What is the purpose of this law suit and why do they withdraw their suit right before the court opening? The purpose is obvious, to stall the removal process of the 5 board members from all members. They had to withdraw their suit because they are afraid the law will come down hard on their heads like a ton of bricks. They lied to the judge with old by-law, and they did some many illegal things violating the very by-law they used against all members from the beginning.
This board has totally lost its legitimacy and trust from all members. They are willing to do anything to achieve their goal. Even to this date, I still cannot figure out their dirty goal. Whoever is in their path will be humiliated, persecuted, impeached, and removed even though they don’t have the power to do so in the By-law. It all doesn’t matter, as long as the board feels like it. Whoever wag his tail and do what they want will prosper and fly to the sky like a little bird. What kind of board we are dealing with? What kind of school they are leading?
Right now, I don’t see a way out. Principal Wang demonstrated 15 years of excellent service to the school, and all he got is accusation, law suits, and removal. Who wants to volunteer for the school any more, other than the little bird? The board should all resign. Otherwise, I will never come back to HXNY any more. How can any one entrust these mafia to educate our kids? Can you?

ReplyDeleteAccording to HXNY Bylaws, the board has the responsibility to set “Tuition, stipend rates, and compensation rates”. Based on the financial report given on 06/19/2011 by school accountant, the school has accumulated money with the amount of $240,000 plus. This money should be used to benefit every students and families directly.
We, as HXNY members, demand this large sum of school money used immediately on all members by reducing this coming school year’s tuitions rate by 50 - 60% (= a savings of between $250.00 and $300.00 per student). Since the board members are given the responsibility to set the tuition, we want to see responsible answer from the board by Wednesday, July 6th, 2011.
If we do not hear any positive announcement regarding tuition reduction after that day, we then will consider the board is not acting on the interests of the members.

If HXNY still have that much money $240,000, it should be given back to all the parents. Reducing the tuition is one of ways. So I hope all the parents when you get this message you should send email to the board members.

朱立 had to go back to China due to family emergency prior to the graduation ceremony. He is back now, but I am sure he has a lot of matters piled up at work and at home. I only knew him since I started negotiating my "centrist compromise", but I am impressed with his capabilities and integrity. I don't think this is the end, let's be patient for a little while longer.

Could you clarify your Connecticut comment? Do you mean Hu Dapeng or Zheng Qi? They are in opposite camps now. All the board members are in NY, and they are certainly not in the same camp. Or maybe you mean me?
ReplyDeleteI don’t think it is a dispute based on zip code. It is one on ideology and principle, i.e., democracy and freedom of speech.
I am also not sure what you mean by 认证, as I never posted on 我要说. Do you mean the CAPTCHA verification? That is merely there to make sure that a human is actually writing the comments, not some genius who knows how to program. Well, a real genius might even beat CAPTCHA, but I think that’s a discussion for a different forum.

ReplyDelete直到五董事把汪校长和蔡教务长告上法院，本人自以为是学校二派系各自拉帮结派，说来说去都是内部矛盾，毕竟都是无偿志愿为学校工作，抢来抢去的只是一份“为人民服务”的苦差事而已。不料事情竟然闹到了法院，再回头看看每一个事件与转折，顿然发现这件事情不简单。隐隐中感觉有一个黑手在幕后掌控，有一个利益在前后贯穿。在罢免五董事的最后关头，这位黑手终于控制不住，从幕后跳到了前台… 您也许已经猜到了，他就是五董事之首，郭刚。
校长选举其实只是一个导火线而已。按正常的董事换届，今年郭刚与杨董离任，而由现任校长及家长会长进入新的一届董事会。但是，郭刚由于“未尽事宜”不愿离任，竟以他一个人的利益把15年的华夏，600多位学生，1000多位的家长们卷入了2011年春夏之交的这场动乱。郭刚是整个事件的总导演。以下是对于整个过程的分析。事先声明，个别素材有个人推理因素，还未经严格校核。您如有怀疑，最好自己再想想…
雷董原本好好地做他的董事，本无心再任校长一职。在郭的一再吹捧下，雷感觉渐好。再有其它几位董事助阵，他已视校长之位是囊中之物。如雷做了校长，谁会弥补这董事会的空缺？根据bylaws，应是今年离任的郭刚。
家长一致反对董事会5/22的决定，校委会，家长会想以家长的投票来迫使董事会撤回决定。郭刚搞来了一份至今来历不明的律师信，威吓家长。校委会无奈临时改成了家长意向调查。雷董仍是校长的唯一候选。
第一次弹劾李董事长的投票倒是进行得顺顺利利。李董事如果下台，郭刚留任董事的几率更大，他乐得顺水推舟。没有人去法院，除了几个领导意图未完全领悟的，甚至都没有人出来阻挠。
倒李失败后，民意要求二队竞选的呼声日高，郭刚意识到雷任校长的概率开始降低。他做了一件常人无法，也不敢想象的事：铲除汪元。他的目的很明确，汪进不了董事会，那董事会的一席就还是他郭董的。为了以防万一，郭刚当即找了律师准备起诉汪。
家长联名要去除五董倒是郭刚未曾料到的。郭刚索性一不做二不休，把蔡一起告上，加了个restraining order以确保最后一周的家长罢免大会开不成。
汪校长被辞职后，按bylaws董事会应从副校长中指定一人为校长。这一决定至今未见任何董事提及。因为一旦指定后，副校长可以进入董事会，郭刚等于白搞了汪元。
在事件最初的几周内，有许多华夏前辈们多次出面调停。但只要解决方案不能保证郭刚继续留任都遭到他的否决。郭刚甚至明确表示他的留任意向，至少二年。更值得一提的是，现在的bylaws正是郭刚上任董事后与他的律师朋友执意修改成如今这样。董事会的权利从那时起已是至高无上的了。
以下的例子是2005年和现行Bylaws的众多改动中的几个：
From 2005 Bylaws: # 6.01.1 The Board consists of seven Directors who must have general membership and are approved by the General Membership meeting to hold a maximum of four year term. 在现行 Bylaws中关键的” approved by the General Membership meeting”一条没有了！
2005 Bylaws: - #12.02 The Board of Directors shall interpret the Bylaw in its application. Final interpretation of the Bylaw shall belong to the General Membership. 现行 Bylaws中第二句去掉了。家长的权力哪去了???
整个事件的推敲中，仍有几点疑问百思不得其解，还望明白人指点迷津：
董事会其余几人为何如此甘愿令郭刚排布？是为看病不花钱？OCA的优秀学生名额？还是有其它把柄捏在了郭董手里？
郭刚为何非要在董事会里再赖上几年？为了中文学校的二十多万？为了圆他几年前买地办Chinese Community Center的梦想？
整个事件很有点政治斗争的色彩，郭董背后还有更高的高手指点吗？
郭刚的下一步会是什么? 投票倒董仍有一周的时间，让我们来猜猜郭刚下一步可能的打算吧：
继续通过律师恐吓威胁家长大会的投票。甚至会采取如上次一般的极端行为。
弹劾并罢免朱会长。这又是违反bylaws的，可能性不大，但以郭刚的手段，也难说。
继续拖延或阻挠提名副校长接任校长一职，让董事会留有空缺。
开始针对曾经的同盟下手，逼现有董事让位与他。以郭刚的品行，眼都不会眨。
有一些家长认为罢免闹得太凶，应该与董事们再谈谈。如果是对一件事的看法不一致，工作方法的不认同，那么我会同意这些家长们的观点。但如果一个人为一己之利，践踏人权，胡作非为，你们对他还有希望吗? 还有更多的家长都抱着无所谓的态度，希望以上的陈述能让你意识到事件的严重性。郭刚需要有这么一个几百个学生的庞大资源为他个人的目的服务。事实证明他会为此不择手段，不惜牺牲他人和中文学校。而华夏的将来将会取决于郭刚的目的是什么，他何时能达到他的目的… 这次事件不是郭刚之流所说的二派之争，说俗了是正义和邪恶之争。有家长贴了下面这句，很贴切地概括了我们面临的危机： “Evils prevail when good men fail to act!” 听从你的良知吧！
